Feds order Discover to refund $200M to cardholders

WASHINGTON (AP) ? Discover Bank will pay millions in fees to settle accusations by regulators that it pressured credit card customers to buy costly add-on services like payment protection and credit monitoring.

Discover, the sixth-biggest U.S. credit card issuer, will pay a $14 million fine and refund $200 million directly to more than 3.5 million customers, federal authorities said Monday.

The company's call-center workers enrolled customers in the programs without their consent, misled them about the benefits and left customers thinking the products were free, regulators said.

The action was brought by the new Consumer Financial Protection Bureau and the Federal Deposit Insurance Corp. Discover said this summer that it expected an enforcement action about add-on products.

It is only the third public enforcement action by the consumer bureau, which was created under the 2010 financial overhaul law to protect consumers from excessive or hidden fees and other financial threats. The first was a similar order against Capital One, another big issuer of cards.

American Express also expects to pay refunds and fines related to add-on products, according to its most recent quarterly filing with regulators.

Discover is part of Discover Financial Services. In a statement late Friday, chairman and CEO David Nelms said: "We have worked hard to earn the loyalty of our cardmembers, and we are committed to marketing our products responsibly."

Discover's telemarketing scripts included misleading language that confused consumers about whether they were buying a product or just agreeing to consider it, the agencies said. They said telemarketers spoke quickly during the part of the call where the prices and terms of products are described.

The order mentions four products sold by Discover: Payment Protection, Credit Score Tracker, Identity Theft Protection and Wallet Protection. Anyone who paid for those services between Dec. 1, 2007, and Aug. 31, 2011, will be repaid at least 90 days' worth of fees. About 2 million customers will be repaid all of the fees they were charged.

In addition to the refunds and fine, Discover agreed to change its telemarketing approach and employ an independent auditor to oversee its compliance with the order.

Dow, S&P flat after German data, but quarter-end eyed

NEW YORK (Reuters) - The Dow and the S&P 500 were nearly flat onMonday as disappointing German data increased concerns that prospects for global economic growth remain weak, but the market gained support from investors' purchases of some of the quarter's better performers.

An index of German business sentiment declined for a fifth consecutive month in September, showing Europe's strongest economy was moving closer toward recession as the euro zone's debt crisis remains unresolved.

Concerns about a stalling global economy were reflected in energy-related shares as the PHLX oil service sector index <.osx> shed 1.3 percent to go with a 1.6 percent drop in U.S. crude oil. Worries about global demand pushed crude prices down more than 6 percent last week.

The S&P 500 rose nearly 6 percent from the start of August through mid-September on expectations of central bank stimulus. On September 6, the ECB announced its bond-buying plan, and a week later, the Federal Reserve announced a third round of quantitative easing intended to bolster the economy and reduce U.S. unemployment.

Normally after such a rally, the market would pull back. But the central bank actions have served to buoy stock prices and prevent a market pullback despite concerns about the global economy. The S&P 500 has been unable to muster a move of more than 0.4 percent in either direction since the Fed's announcement.

As the end of the third quarter approaches, investors are participating in "window dressing," where fund managers add some of the latest outperformers to their portfolio. The S&P 500 is up 7.1 percent for the quarter so far.

"Hedge funds remain somewhat short the market, and the end of the quarter is coming up, so I wouldn't be surprised to see equity markets push a bit higher over the near term," said Michael Sheldon, chief market strategist of RDM Financial, in Westport, Connecticut.

The Dow Jones industrial average <.dji> was up 6.18 points, or 0.05 percent, at 13,585.65. The Standard & Poor's 500 Index <.spx> was down just 0.95 of a point, or 0.07 percent, at 1,459.20. The Nasdaq Composite Index <.ixic> was down 16.60 points, or 0.52 percent, at 3,163.36.

For the third quarter so far, the energy sector has performed well, with the S&P energy index <.gspe> up 10.9 percent. The tech sector also has ranked among the better performers, with the S&P tech index <.gspt> up 8.8 percent for the quarter.

In Monday's session, investors bought utility stocks. The S&P utilities index <.gspu> was up 1.1 percent.

Transports also proved to be appealing in Monday's trading. The Dow Jones Transportation Average <.djt> was up 1.1 percent.

Apple Inc , down 1.5 percent to $689.49, was the biggest drag on the Nasdaq 100 index <.ndx> even as its latest iPhone sold out. Concerns arose that the company was unable to produce the new phone quickly enough to meet demand.

Homebuilder Lennar Corp reported steep increases in its third-quarter earnings and revenue, while orders rose 44 percent. Despite the solid results, Lennar's stock slid 1.5 percent to $36.94.

Lennar's results follow a similarly strong report from KB Home and together indicate the housing market is moving toward recovery.

Melbourne researchers have identified a new way of protecting female fertility, offering hope to women whose fertility may be compromised by the side-effects of cancer therapy or by premature menopause.

The researchers, from the Walter and Eliza Hall Institute, Monash University and Prince Henry's Institute of Medical Research, made the discovery while investigating how egg cells die.

They found that two specific proteins, called PUMA and NOXA, cause the death of egg cells in the ovaries. The finding may lead to new strategies that protect women's fertility by blocking the activity of these two proteins.

Associate Professor Clare Scott from the Walter and Eliza Hall Institute said the research showed that when the DNA of egg cells is damaged following exposure to radiation or chemotherapy, such as that received during some cancer treatments, PUMA and NOXA trigger the death of the damaged eggs. This egg cell death causes many female cancer patients to become infertile.

"PUMA and NOXA can trigger cell death, and have been found to be necessary for the death of many different cell types in response to DNA damage," Associate Professor Scott, who is also an oncologist at The Royal Melbourne and Royal Women's Hospitals, said. "This removal of damaged cells is a natural process that is essential to maintaining health but, for women undergoing cancer treatment, can be devastating when it leads to infertility."

Associate Professor Scott, Dr Ewa Michalak and Professor Andreas Strasser from the Walter and Eliza Hall Institute, together with Associate Professor Jeffrey Kerr from Monash University, and Dr Karla Hutt and Professor Jock Findlay from Prince Henry's Institute of Medical Research, focused their studies on egg cells called primordial follicle oocytes, which provide each woman's lifetime supply of eggs. Low numbers of these egg cells can also be a cause of early menopause. Their findings are published online this week in the journal Molecular Cell.

Associate Professor Jeff Kerr said that when these egg-producing cells were missing the PUMA protein, they did not die after being exposed to radiation therapy. "This might ordinarily be cause for concern because you want damaged egg cells to die so as not to produce abnormal offspring," he said. "To our great surprise we found that not only did the cells survive being irradiated, they were able to repair the DNA damage they had sustained and could be ovulated and fertilized, producing healthy offspring. When the cells were also missing the NOXA protein, there was even better protection against radiation."

"We were very excited to see healthy offspring could be produced from these cells," Associate Professor Scott said. "It means that in the future, medications that block the function of PUMA could be used to stop the death of egg cells in patients undergoing chemotherapy or radiotherapy. Our results suggest that this could maintain the fertility of these patients."

A joint leader of the study, Professor Jock Findlay, head of the Female Reproductive Biology Group at Prince Henry's Institute, said the study could also have implications for delaying menopause. "We know that the timing of menopause is influenced by how many egg cells a female has," he said. "Interventions that slow the loss of egg cells from the ovaries could delay premature menopause. As well as prolonging female fertility, such a treatment could have the potential to reduce menopause-associated health conditions, such as osteoporosis and heart disease."

US releases names of 55 Guantanamo detainees

SAN JUAN, Puerto Rico (AP) ? The U.S. Justice Department on Friday made public the names of 55 Guantanamo prisoners who have been approved for transfer to the custody of other countries, releasing information sought by human rights organizations.

The announcement, which reverses a 2009 decision, was a surprise to organizations that had filed FOIA requests seeking the information.

"We did not expect this," said Omar Farah, attorney for the Center for Constitutional Rights. "This is an important development."

Farah said the government's action will be a boost for lawyers representing detainees at the U.S. military base in Cuba. "We can now advocate publicly for the release of our clients by name," he said.

The government's move has no immediate, practical effect on the inmates' detention. Inclusion on the list does not mean that the U.S. has absolved them of any wrongdoing or that it believes they pose no threat, and there was no indication of when any might be sent elsewhere.

In 2009, Ambassador Daniel Fried, the Obama administration's special envoy on detainee issues, argued then that it was necessary to keep the prisoners' identities secret while the U.S. negotiated transfers to other countries.

"It is important for the U.S. government to have the latitude to approach potential destination countries in a discreet and confidential manner, in order to minimize the risk of undue publicity," Fried said in a statement at the time.

But the government said in a court filing Friday that the successful transfers of other detainees no longer warranted such concerns. It noted that 40 detainees have been resettled in new countries and 28 were repatriated to their native countries since 2009.

ACLU lawyer Zachary Katznelson welcomed the naming of 55 prisoners approved for transfers, saying it could help speed up their release to another country. "Their lawyers can publicly push for their transfer," he said.

But he urged the government to release the names of 31 other detainees also approved for transfer.

"Today's release is a partial victory for transparency, and it should also be a spur to action," he said. "These men have now spent three years in prison since our military and intelligence agencies all agreed they should be released."

Katznelson said the ACLU has also filed an FOIA request seeking the names of prisoners in three other categories: indefinite detention, conditional detention and prosecution.

Suzanne Nossel, executive director of Amnesty International USA, said the 55 detainees named should be transferred immediately out of Guantanamo.

"Indefinite detention is a human rights violation and it must end," she said.

Most of the detainees on the list are from Yemen, including Mohammed Al-Hamiri, whom Farah represents.

Farah said more than one-third of Guantanamo's prisoners are men from Yemen who have been cleared for transfer. Currently, the U.S. will not move any Yemeni detainees back to their home country because the U.S. believes it is not stable enough to prevent them from potentially resuming militant activity.

There are 167 detainees now at Guantanamo.

As Scientists Question New Rat Study, GMO Debate Rages On

The headlines on the press releases that started showing up yesterday, here at The Salt certainly got our attention. Just one sample: "BREAKING NEWS: New Study Links Genetically Engineered Food to Tumors."

The reason for all the excitement was a study published this week in the well-respected journal Food and Chemical Toxicology. The French scientists who conducted the study basically concluded that rats fed a diet of genetically modified corn and small amounts of herbicides got sicker faster than their counterparts eating regular corn and no herbicides.

Based on the study, several anti-GMO groups are calling for a ban and the French government is calling for more investigation, but many scientists met the research with a heavy dose of skepticism.

The study describes an experiment in which scientists fed 18 different groups of rats (ten rats in each group) various concentrations of a genetically engineered kind of corn and/or small amounts of the herbicide Roundup. (Roundup is widely used in combination with genetically engineered "Roundup Ready" crops.)

Two control groups got a diet of non-modified corn and no Roundup. The experiment went on for two years, an unusually long time. Most experiments with rats that attempt to measure the toxic effects of chemicals last only 90 days.

On average, the rats that ate GM corn or drank water laced with Roundup did worse than the control group. Tumors showed up earlier (at least in some of the groups) and more rats died than in the control groups. The contrast was most stark among female rats.

So is this solid evidence that GM corn (or other crops) are bad for you? The author of the paper, Gilles-Eric Seralini, who has been campaigning against GM crops since 1997, says yes. Definitely yes.

Other scientists say, absolutely not.

Some of their complaints about the study are aimed at the study's methods. Critics point out that the type of experimental rats used in this study are particularly prone to tumors. So if you divide up 200 of them into twenty groups, as this study did, you are likely to get very high tumor rates in some of the groups. And the fact that such clusters of tumors didn't show up in the two small control groups could easily be due to random chance.

One particularly irreverent critic, Michael Grayer, a medical statistician, pointed out that the study included 18 groups of rats that were exposed to GMOs or Roundup (nine each for male and female rats), compared to only two control groups. "The potential for cherry-picking the nice positive results here from a sea of boring null ones is immense," he wrote on his blog. "Not saying they did it, of course, but it's certainly a concern."

Also, if this experiment truly showed a link between genetically engineered food and tumors, one might expect the rats that ate more of the GM corn to develop more tumors. In fact, the opposite happened. The rats eating a diet of 33 percent GMO corn stayed healthier than animals eating food with a GMO concentration of just 11 percent.

Seralini, for his part, says that this simply shows that GMOs are toxic in a different way. They merely need to rise above a certain threshold level to have harmful effects; increasing the concentration doesn't increase the harm.

Some scientists were inclined to dismiss the study simply based on Seralini's history of anti-GMO claims. "I know this guy. He has published a lot of rubbish," says Harry Kuiper, a Dutch scientist who used to be in charge of the European Commission's research program on the safety of genetically modified foods. That program sponsored many previous studies, including animal feeding studies, which came to less alarming conclusions and got much less attention than Seralini's.

In fact, Kuiper and many of his colleagues don't even think that animal feeding studies are a very good tool for studying the safety of GM foods. If there was a harmful chemical hidden in GM corn, they say, such studies wouldn't be likely to catch it, because rats can't eat enough corn for them to get a harmful dose of the toxic or cancer-causing substance.

But apart from methodological concerns and personal animosity, there's a deeper reason why scientists like Kuiper give little credence to Seralini's studies. There's a saying in science: Extraordinary claims require extraordinary evidence. For most of the scientists who have been studying the safety of GMOs, it's an extraordinary claim, at this point, to assert that the current generation of genetically modified crops are harmful to human health.

There's no apparent reason why that should be true; No one has found new toxic substances in these crops. And the giant feeding experiment that's been going on for the past fifteen years ? hundreds of millions of Americans consuming GMO ingredients ? hasn't produced evidence of harm, either.

It would take a lot more evidence that the results of this study to change their minds.

CAIRO (AP) ? The image of an Ottoman sultan glowered at the gridlock from a highway billboard in the Egyptian capital, hands clasped, his feathered headgear and gold-hewn epaulettes in elegant contrast to the grind of traffic below. The poster for a Turkish-made movie about the 1453 fall of Constantinople recalled the early feats of an empire that eventually ruled the Middle East and beyond.

Egypt, like Turkey, has its own grand history ? evident in the pyramids and other monuments that its ancients left behind, and in a national pride that's distinctive in the Arab world.

The descendants of yesterday's sultans and pharaohs, so to speak, also have ambitions of an outsized role for their respective countries. Each wants to speak for the Middle East.

But they can't go it alone so Turkey and Egypt now talk of working together. In some ways, it's an odd couple.

Turkey is relatively stable and prosperous, though its foreign outreach has soured in some quarters, forcing it to tone down ambitions to become a statesman above the Mideast fray.

Egypt, the most populous Arab country, is struggling with problems at home. Analysts believe it will be at least several years before Cairo can play a robust role in a region that rolls from one crisis to the next, divided over everything from religion to modernity.

Their alliance could work if Egypt follows Turkey's moderate creed of reform and pragmatism, along with Western ties and Islamic piety. Then again, once Egypt gains more confidence, the two nations might jostle for influence.

Turkey's outreach (in this case, deep pockets) was on show Monday in Cairo. Turkish Foreign Minister Ahmet Davutoglu said his government would give $2 billion in aid to Egypt to "increase trust" in its economy, beset by a drop in productivity, a tourism slump, strikes and protests since the fall of authoritarian leader Hosni Mubarak in an uprising last year.

"The Egyptian territory is a fertile land where great civilizations were formed. We will witness Egypt's rise in the future," Davutoglu said. "With Egypt and the participation of other states, we will build a new Middle East."

The two nations both want President Bashar Assad of Syria to quit and Iran, his ally, to stay out of the civil war there.

In the Middle East, though, diplomacy and compromise seem in perpetual peril.

Israel ponders a military strike on Iran's nuclear facilities, fearing its enemy wants to build a bomb. Syria's civil war resembles a proxy conflict with a sectarian edge. Violence surrounding a film that insults Prophet Muhammad and was produced in the United States points to old tensions between Western and Islamic thought.

Turkey, a NATO member with a mostly Muslim (but not Arab) population, has been touted as a democratic model for a region swept by popular revolts.

But rough-and-tumble foreign relations have removed some of the shine. Turkey split with former ally Israel and sparred with traditional rival Iran. It doesn't get along well with the Shiite-led government in Iraq, sheltering its Sunni vice president even after a Baghdad court sentenced him to death for running death squads.

The pivot to Egypt offers welcome relief, though a closer alliance with another major state with a Sunni Muslim majority could feed suspicions that the Sunni-Shiite sectarian divide in the Middle East is deepening.

Turkey is not quite a regional power and it has its own internal challenges such as a Kurdish insurgency, noted Arda Batu, editor in chief of the Turkey-based Kalem Journal, a website about regional affairs.

Turkey is in a state of "having a degree of influence in the region, and having the power to impact certain outcomes ? not solely, but through alliances," Batu wrote in an email to The Associated Press. Of its troubled ties with several neighbors, he said: "Turkey doesn't have the luxury to have so many enemies."

Egypt's Islamist president, Mohammed Morsi, has sought to reassert Cairo's leadership in the Middle East with condemnation of the Syrian regime. But his administration is beset with domestic problems, including security, unemployment, poor infrastructure and divisions between Islamists and secularists.

Michael Hanna, an Egypt expert at the New York-based Century Foundation, said it will take a while for Egypt to become a "really engaged player" in the region ? and only if the country becomes unified and the economy gets moving.

According to Hanna, there is a "certain yearning among many in the Arab world to see Egypt restored to its rightful place" as a leader. Pride in Egypt stems partly from its ancient past, a pan-Arab ideology under President Gamal Abdel Nasser half a century ago that ultimately fell short, and the trove of films, literature and other cultural exports.

Then there's the question of how public a role should religion play. Turkey's creed of religious piety and secular ideals, still a source of domestic division, has not always traveled well in the region. Egypt's new government is dominated by the Muslim Brotherhood, which espouses an "Islamic identity" for the country.

Morsi might have an edge if Egypt and Turkey compete as peacemakers in the Israeli-Palestinian conflict, said Nora Fisher Onar, an assistant professor of international relations at Bahcesehir University in Istanbul, Turkey.

In an analysis, she wrote: "He has a home-field advantage as an Arab in a region where many still rankle from Ottoman domination."

Singer Fiona Apple was arrested Wednesday night for hashish possession and is being held in the Hudspeth County Jail in Sierra Blanca, Texas, a jail official confirmed to TODAY.

Apple was arrested around 10 p.m. CT Wednesday night, the official said, and as of Thursday morning, was still jailed waiting for bond to be set, the official said.

The drug was reportedly found on her tour bus, according to TMZ.com, which also reports some marijuana was found.

Apple is scheduled to play the Moody Theater in Austin, Texas, on?Thursday night and then play a concert in Houston on Friday night. A call placed to the Moody Theater was not immediately returned.

Apple is far from the only singer to spend time in the Hudspeth County Jail for drug charges. The Huffington Post reports?that Willie Nelson, Snoop Dogg and actor Armie Hammer are among those who have arrested at a nearby border-patrol checkpoint. According to the Huffington Post, "drug-sniffing dogs inspect more than 17,000 trucks, travelers and tour buses daily" at the checkpoint.

An international three-man crew onboard a Russian-made Soyuz capsule touched down successfully on the cloudless central Kazakhstan steppe Monday morning after 123 days at the International Space Station.

The capsule, carrying U.S. astronaut Joseph Acaba and Russian cosmonauts Gennady Padalka and Sergei Revin, parachuted through a blue sky and touched down in a cloud of dust as its soft landing engines ignited at 8:53 local time (0253 GMT).

"Bull's eye landing," a NASA TV commentator said as the capsule lay on its side in the Kazakh steppe circled overhead by approaching search-and-recovery helicopters.

Veteran mission commander Padalka, who has logged 711 days in orbit to make him the world's fourth most experienced astronaut, was the first out of the cramped descent capsule.

"I feel great," said Padalka, wrapped in a blue blanket, sipping hot tea and smiling, enjoying the balmy steppe air under the early morning sunlight as medical personnel wiped sweat from his brow.
"This was my fourth flight, and so it is nothing of the extraordinary already," he said, looking relaxed.

During his stay at the orbital station, Padalka conducted a six-hour spacewalk on Aug. 20 to relocate a crane, launch a small science satellite and install micrometeoroid shields on the space station's Zvezda command module.

He and fellow crew members Acaba and Revin were carried over to autograph the Soyuz, scorched black by re-entry, to be displayed in a Russian provincial museum.

The crew returned after spending 123 days in orbit aboard the International Space Station, a $100 billion research complex involving 15 countries and orbiting 240 miles (385 km) above Earth.

The mission was shorter than the usual six months after launch delays in order to ready a new spaceship to replace the initial Soyuz craft, which was cracked during pressure tests.

Moscow hopes Monday's smooth landing will help to ease concerns over relying solely on Russia to service the ISS following a string of recent mishaps in its space programme.

"Everything is to cheer today," Russian space agency chief Vladimir Popovkin told reporters at Mission Control in Moscow.
"Padalka, Revin and Acaba are feeling well, and they will all go home today."

Three other International Space Station crew members - veteran Russian cosmonaut Yuri Malenchenko, NASA astronaut Sunita Williams and Japanese astronaut Akihiko Hoshide - remain in orbit.

They are scheduled to be joined by another trio - Kevin Ford, Oleg Novitsky and Yevgeny Tarelkin - due to blast off from the Baikonur cosmodrome in Kazakhstan next month.

That mission was scheduled to launch on October 15 but will be delayed by about a week due to a technical glitch with equipment aboard the Soyuz, Popovkin said.

"We've had a worry over one of the devices. We decided to change it, test it again and so the launch has been put off by one week," Popovkin said.

The Soviet Union put the first satellite and the first man in space, but Russia's space programme has suffered a series of humiliating set-backs in recent months that industry veterans blame on a decade of crimped budgets and a brain drain.

While none of the mishaps have threatened crews, they have raised worries over Russia's reliability, cost billions in satellite losses and dashed Moscow's dreams to end a more than two-decade absence from deep-space exploration.

Since the retirement of the U.S. space shuttles last year, the United States is dependent on Russia to fly astronauts at a costs to the nation of $60 million per person.

Newspaper suspensions lifted in Ivory Coast

ABIDJAN, Ivory Coast (AP) ? Ivory Coast's press council has lifted suspensions at least temporarily on all six newspapers allied with former President Laurent Gbagbo after the shutdown drew international criticism.

The newspapers were suspended last week for publishing photos of officials whom Gbagbo tried to name to his Cabinet after he lost the November 2010 election to current President Alassane Ouattara. The photos listed the officials' Cabinet positions, which Ouattara voided after Gbagbo was detained in April 2011.

The U.S. Embassy in Abidjan and Reporters Without Borders swiftly spoke out against the suspensions.

Raphael Lakpe, chairman of the National Press Council, said the suspensions were lifted partly at the behest of the country's truth commission. He added that the suspensions could be reinstated if the papers published further content the council found objectionable.
